DESCRIPTION:Prof. Elie J. Sung\, HEC Paris\n"Non-market Strategy Performan
ce in the Court: The Role of Information and Legitimacy"\n\n\nAbstract : \
nThis paper examines performance determinants of firms’ nonmarket strate
gy in shaping public policy outcomes in courts. Building on the political
markets framework and the legitimacy perspective\, we argue that the perfo
rmance of nonmarket strategy depends more on the ability to display legiti
macy than on providing policymakers with informational content. Using a pa
nel of 1\,155 interest groups engaged 2\,549 times in patent-related U.S.
Supreme Court cases over a 15-year period\, we find empirical support that
policymakers use the interest groups’ expertise to legitimate their dec
ision rather than to learn from it.\n\n
