"Non-market Strategy Performance in the Court: The Role of Information and Legitimacy"


Abstract :
This paper examines performance determinants of firms’ nonmarket strategy in shaping public policy outcomes in courts. Building on the political markets framework and the legitimacy perspective, we argue that the performance of nonmarket strategy depends more on the ability to display legitimacy than on providing policymakers with informational content. Using a panel of 1,155 interest groups engaged 2,549 times in patent-related U.S. Supreme Court cases over a 15-year period, we find empirical support that policymakers use the interest groups’ expertise to legitimate their decision rather than to learn from it.
